• A current Florida Department of Business Professional Regulation (DBPR) Mobile Food Service License must be kept inside the vehicle.

• Permission from a site owner to operate on their property must be kept inside the vehicle and must indicate the specific hours and days of the week food vending will occur at the location.

Mobile Food Vending is allowed within the following Palm Bay zoning districts:

• CC, Community Commercial
• HC, Highway Commercial
• BMU, Bayfront Mixed Use
• LI, Light Industrial

The four zoning districts to accommodate Mobile Food Vending in Palm Bay can be found within the following quadrants of the City:

Mobile Food Vending cannot occur within the following locations:

• City parks or on City property, except as permitted by a City-sanctioned event or activity. The Palm Bay Parks and Recreation Department can be contacted at (321) 726-5671 regarding special events.
• Residentially zoned and/or a residential portion of a mixed-use zoning district, except as permitted by a City-sanctioned event or activity.

Mobile Food Vending can occur in the City between the hours of 6:00 a.m. and 2:00 a.m., but vehicles cannot park or operate at a site for more than 12 consecutive hours.

• Mobile Food Trucks shall be operated only by the Mobile Food Vendor or by an authorized employee of the vendor.
• Mobile food trucks shall be self-contained when operating, except for the required trash and/or recycling receptacles that shall be attached to the mobile food truck.
• Mobile food vendors shall remove all waste and trash prior to vacating their location.
• Under no circumstances shall grease or any waste materials be released into the stormwater system, tree pits, sidewalks, streets, parking lots, or private/public property. Mobile food vendors are responsible for properly discarding waste materials in accordance with any federal, state, county, and municipal laws or regulations.
• All food service equipment utilized by vendor shall be maintained in good repair and a clean condition.
• No more than two mobile food trucks shall operate on any property at any one time, except as may be permitted by a special event permit issued by the City.
• In addition to the location of the mobile food truck, one (1) 10-foot x 10-foot area, covered or uncovered, may be permitted to accommodate seating and tables.
• One (1) 10-foot x 10-foot tent may be utilized to cover the seating area mentioned above.

Mobile Food Vendors are also prohibited from:

• Selling or distributing alcoholic beverages.
• Serving food from a free-standing barbecue grill.
• Operating on a public right-of-way, driveway, driveway aisle, loading zone, or no parking zone.
• Operating in a fire lane or blocking fire hydrants or any other fire protection devices and equipment, or Americans with Disabilities Act (ADA) accessible parking spaces and/or accessible ramps.
• Operating in a location that will impede on-site circulation of motor vehicles or pedestrians.
• Occupying any parking spaces required of a given business or commercial center.
• Operating on unimproved surfaces and abandoned or vacant business locations.
• Use of sound amplification regardless of intended purpose.
• Using balloons, banners, streamers, large flashing lights, or other similar devices to attract customers.
• Selling or dispensing food to customers in a moving vehicle or otherwise engaging in drive-up sales.
